Substantiated sex-related offenses must be documented in official records

Any complaint of a sex-related offense committed by an Airman occurring on or after Dec. 26, 2013 that resulted or results in conviction by court-martial, non-judicial punishment or punitive administrative action must be documented on the offender's enlisted performance report, officer performance report, training report or mandatory letter of evaluation, Air Force officials said this week.

The requirement, directed in the fiscal year 2014 National Defense Authorization Act, requires all services to document the information in official personnel records. Offenses include those defined in Articles 120, 120a, 120b, 120c and 125 of the Uniform Code of Military Justice which range from rape to stalking.

Any substantiated offense that occurred on or after the effective date that has not yet been documented in the Airman's record must be included in his or her next EPR, OPR, TR or mandatory LOE (Air Force Form 77, Letter of Evaluation).

For enlisted members, documentation must be accomplished by the administrative unit commander. For officers, documentation must be accomplished by the senior rater. For deployed commanders, the documentation is accomplished on the LOE (deployed commanders must accomplish an optional LOE on all Airmen returning from deployment who have substantiated sex-related offenses).
